NOTICE TO BIDDERS

EAST BAY REGIONAL PARK DISTRICT

 

NOTICE IS HEREBY GIVEN that the EAST BAY REGIONAL PARK DISTRICT (“District”) is inviting bids for furnishing all labor, material, tax, transportation, equipment, and services necessary for Job Order Contracts (JOC-037, JOC-038) in accordance with the bid documents and specifications now on file with the District. A bidder may be awarded at most one (1) contract from this solicitation.

MULTIPLE FUNDING SOURCES: The Contract may be funded, in whole or in part, with Federal or Grant funds. The District’s receipt of such funds, and ability to compensate the Contractor in connection with the Contract using such funding, is conditioned upon the Contractor’s compliance with certain mandatory terms and conditions. As such, the Contractor and each of its subcontractors must comply with all the terms and conditions set forth within the General and Supplementary Conditions included in the project manual.

 

PROJECT DESCRIPTION:  A Job Order Contract is an indefinite quantity contract pursuant to which the Contractor may perform an ongoing series of individual Projects at different locations throughout the District. The bid documents include a Construction Task Catalog® containing construction tasks with preset Unit Prices. All Unit Prices are based on local labor, material and equipment prices and are for the direct cost of construction.


The Contractor will bid two Adjustment Factors to be applied to the Unit Prices. One Adjustment Factor is for performing work during Normal Working Hours, a second Adjustment Factor is for performing work during Other Than Normal Working Hours. The same two Adjustment Factors shall apply to every Pre-priced Task in the Construction Task Catalog®.

 

TERM: The Term of the Contract is one year. All Job Orders issued during the term of this Contract shall be valid and in effect notwithstanding that the Detailed Scope of Work may be performed, associated Supplemental Job Orders may be issued, payments may be made, and the guarantee period may continue, after such period has expired. All terms and conditions of the Contract apply to each Job Order.

The Contractor is guaranteed to receive the opportunity to perform Job Orders totaling at least $50,000 during the Term of each of the Contracts. The Maximum Contract Value for each Contract is as indicated in the chart to the right. Pending District Board approval, District has the option to increase each contact to the State Maximum allowable by the Public Contract Code Section 20128.5, adjusted annually to reflect the percentage change in the California Consumer Price Index since January 1998, which at this time is approximately $5,098,418.  Contractor is not guaranteed to receive the Minimum Contract  volume of Job Orders. The District has no obligation to issue Requests for Proposals and/or Job Orders in excess of the Minimum Contract Value.

A bidder must purchase a complete set (hard or electronic copy) from BPX Printing and Graphics to be considered responsive and to receive addenda notifications. There is a non-refundable fee of $500 PER SET for a bid package, plus shipping and handling if necessary.

There will be a check-in period until 1:05pm and attendance will be recorded. Note that persons entering the meeting after 1:25pm will be considered as not attending the meeting and will be considered non-responsive for bidding. The purpose of the pre-bid conference is to discuss the Job Order Contract (JOC) concept and documents, answer questions and discuss JOC from the contractor’s perspective. Bids submitted by firms not represented at the mandatory pre-bid conference will not be considered.

After bid opening, all bids received will be posted to the Park District Planroom website under the “Bid Results” tab.

 

Please note that bidders must be logged-in as a registered user in order to see the “Submit Bid Docs” tab. The “Submit Bid Docs” tab will only be available until the bid deadline, and all submitted bids are “sealed” and inaccessible until that time. After the bid deadline, the “Submit Bid Docs” tab will be unavailable on the Planroom platform to prospective bidders.

Prospective bidders are required, as part of the Bid submittal, to provide references for at least three (3) general engineering projects completed within the last five (5) years.

 

PROOF OF DIR REGISTRATION:  Contractor will be required to submit DIR registration numbers for their company and all subcontractors.  Contractor shall provide for each subcontractor the DIR PWC100 contractor/subcontractor registration number or registration page confirming the subcontractors’ registration with DIR. See Information for Bidders for Licensing and DIR Registration requirements.

 

EAST BAY REGIONAL PARK DISTRICT selected The Gordian Group’s (Gordian) Job Order Contracting (JOC) System for their JOC program. The Gordian JOC Solution™ includes Gordian’s proprietary JOC Software Applications, construction cost data, and Construction Task Catalog®, which shall be used by the Contractor solely for the purpose of fulfilling its obligations under this Contract, including the preparation and submission of Job Order Proposals, subcontractor lists, and other requirements specified by the Owner. The Contractor shall be required to execute Gordian’s JOC System License and Fee Agreement, and pay a 1% JOC System License Fee (License Fee) on all Job Orders issued to obtain access to the Gordian JOC Solution™. The License Fee is to be included in the Contractor’s Adjustment Factors.

 

Bids shall be uploaded to the District’s online Planroom at the above website and page before 2:00 pm, on January 23, 2024. Bids will be publicly opened via an online conference at that time. All bids must be accompanied by certified check, cashier’s check or bid bond made payable to East Bay Regional Park District in the sum of twenty five thousand dollars ($25,000). The check or bonds shall be given as a guarantee that the successful bidder will enter into a written contract within ten (10) calendar days after being requested to do so and will be considered as the stipulated amount of liquidated damages in the event the bidder is unable to or refuses to execute a contract for the work.
