LEGAL NOTICE

NOTICE TO BIDDERS

 

Notice is hereby given that Burbank Unified School District (hereinafter referred to as "Owner") will receive sealed bids prior to the date and time stated for the Bid Opening for the award of the Contract to construct:

Bid 2425-003: Aquatic Center Modernization and New Storage Building at Burbank High School (DSA 03-122682 & DSA 03-123187)

Plans and specifications may be obtained from the District’s Purchasing Website, www.burbankusd.org/purchasing, under the heading Contract and Bids, or from

Architectural, Informational, Bid, and Contract documents will be available for viewing and downloading beginning on September 16, 2024, at no cost at the locations listed above. Any cost related to the printing of documents shall be the sole responsibility of the bidder. While the Documents may be available through other sites, the District does not guarantee the authenticity or completeness of documents obtained from such other sites.

The Project consists of (2) DSA Projects.  DSA Project 03-122682, Aquatic Center Modernization and DSA Project 03-123187, New Storage Building with Bleacher Seating. Bid amounts (including a Schedule of Values) for each project must be calculated separately and listed on the Bid Form. The estimated value of the combined project is $4,000,000.

This Project is subject to prequalification pursuant to Public Contract Code section 20111.6. Prequalification application is available with the Bid Documents listed above. All prime contractors (and subcontractors whose subcontracts are valued at $25,000 or more) must submit a completed Prequalification Application by 12:00 pm on October 4, 2024. Notice of prequalification status (approved or rejected) will be sent to each applicant by 12:00 pm on October 11, 2024.

Public works projects are subject to compliance monitoring and enforcement by the Department of Industrial Relations. For all projects over Twenty-Five Thousand Dollars ($25,000), a contractor or subcontractor shall not be qualified to submit a bid or to be listed in a bid proposal subject to the requirements of Public Contract Code section 4104 unless currently registered and qualified under Labor Code section 1725.5 to perform public work as defined by Division 2, Part 7, Chapter 1 (§§ 1720 et seq.) of the Labor Code. For all projects over Twenty-Five Thousand Dollars ($25,000), a contractor or subcontractor shall not be qualified to enter into, or engage in the performance of, any contract of public work (as defined by Division 2, Part 7, Chapter 1 (§§ 1720 et seq.) of the Labor Code) unless currently registered and qualified under Labor Code section 1725.5 to perform public work.

Bids must be sealed and filed in the Business office of the Owner at 1900 West Olive Avenue, Burbank, CA 91506-2460 by 2:00 pm on October 30, 2024, on the clock designated by the Owner or its representative as the bid clock, after which time bids will be opened. No bid will be accepted by Owner after this time. The bid number and description shall be stated on the outside of the envelope. Facsimile (FAX) and email copies of the bid will not be accepted. The District Business Office is open from 8:00 am to 4:00 pm, Monday through Friday. All bids will be time stamped upon receipt.

A mandatory Pre-bid conference will be held on September 26, 2024, at 9:00 am at Burbank High School, 902 N Third St., Burbank, CA 91502.

Bids must be accompanied by a bidder's bond, cashier's check, or certified check for at least ten percent (10%) of the amount of the base bid(s) and made payable to the Owner.

Bids must also be accompanied by an executed Fingerprinting Notice and Acknowledgment, Designation of Subcontractors, Workers Compensation Certification, Non-Collusion Declaration, and Schedule of Values. Incomplete, inaccurate or untrue responses or information provided by a Bidder in the Bid Proposal or any document accompanying the Bid Proposal shall be grounds for the District to reject such Bidder’s Bid Proposal as non-responsive.

Substantial Completion of the Work subject to each Bid Package shall be achieved according to the schedule included in the Project Manual and according to the terms of the General Conditions.

Pursuant to Public Contract Code Section 20103.8 (d) the lowest bid shall be determined in a manner that prevents any information that would identify any of the bid amounts or details from being revealed to the public entity prior to the opening of the bids.

Additional documents required upon award of contract include (but are not limited to): Agreement, Independent Contractor Student Contact Form, and a Statement of Guarantee.

Pursuant to the Contract Documents, the successful bidder will be required to furnish a Payment (Labor and Material) Bond in the amount of one hundred percent (100%) of the Contract Sum, and a Faithful Performance Bond in the amount of one hundred percent (100%) of the Contract Sum. The bidder will be required to furnish insurance as set forth in the Contract Documents.

The successful bidder will be allowed to substitute securities or establish an escrow in lieu of retainage, pursuant to Public Contract Code Section 22300, and as described in the Agreement Between Owner and Contractor and General Conditions.

The Owner will not consider or accept any bids from contractors who are not licensed to do business in the State of California, in accordance with the California Public Contract Code, providing for the licensing of contractors. In accordance with Section 3300 of said Code, the bidder shall have a Class “A” or “B” license and shall maintain that license in good standing through Project completion and all applicable warranty periods. Bidder shall list all subcontractors doing more than one-half of one percent (0.5%) of the bidder’s total bid on the Designation of Subcontractors form; all listed subcontractors shall, at the time of the bid, have valid and current licenses applicable to the work proposed; and bidder shall state such license number on such form.

Subcontractors shall maintain their licenses in good standing through Project completion and all applicable warranty periods. Owner reserves the right to reject any bid if bidder is not licensed in good standing at the time of the bid or anytime thereafter, or if a listed subcontractor is not licensed in good standing at the time of the bid or anytime thereafter to do the work for which it is listed.

The Director of Industrial Relations of the State of California, in the manner provided by law, has ascertained the general prevailing rate of per diem wages and rate for legal holidays and overtime work. The Contractor must pay for any labor therein described or classified in an amount not less than the rates specified.

The Owner will retain 5% of the amount of any progress payments.

The Owner reserves the right to waive any irregularity and to reject any or all bids.
